1. Definitions

• “Service” means the MyTradePlatform web application and iOS mobile application, including all features, updates, and related documentation.
• “Platform” means the software, infrastructure, and systems that deliver the Service.
• “Subscriber”(also “you”, “your”) means the individual or business entity that registers for and uses the Service.
• “Business Data” means all data entered into the Platform by the Subscriber, including client records, job details, invoices, appointments, notes, and any uploaded files.
• “We”, “us”, “our” means MyTradePlatform, operated by Richard Harold.

2. Acceptance of terms

By creating an account on MyTradePlatform, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you are registering on behalf of a business, you confirm that you have authority to bind that business to these terms.

If you do not agree to these terms, you must not use the Service. We may update these terms from time to time and will notify you of material changes by email or in-app notice. Continued use of the Service after such notification constitutes acceptance of the updated terms.

3. Service description

MyTradePlatform is a business management platform designed for UK trade and service professionals. The Service provides job management, client management, appointment scheduling, invoicing, and related features to help you run your business more efficiently. The Service is available via a web application and an iOS mobile application with offline capability.

4. Subscription and payment

4.1 Free trial

New subscribers receive a 7-day free trial with full access to all features. No payment card is required to start the trial.

4.2 Pricing

After the free trial, the Service costs £18 per month. All prices are inclusive of VAT where applicable. We reserve the right to change pricing with at least 30 days' notice.

4.3 Payment

Payments are processed securely by Stripe, Inc. By subscribing, you authorise recurring monthly charges to your chosen payment method. You are responsible for keeping your payment details up to date.

4.4 Cancellation

You may cancel your subscription at any time via the Customer Portal accessible from your account settings. Upon cancellation, you will retain access to the Service until the end of your current billing period. No refunds are given for partial months.

5. Acceptable use

You agree to use the Service only for lawful business purposes. You must not:

• Use the Service for any illegal activity or in violation of any applicable law or regulation
• Misrepresent your identity or the nature of your business
• Resell, sublicense, or provide access to the Service to third parties without our written consent
• Attempt to reverse-engineer, decompile, or extract the source code of the Platform
• Interfere with or disrupt the Service or its infrastructure
• Upload malicious code, viruses, or any content designed to harm the Platform or other users

We reserve the right to suspend or terminate accounts that violate these terms.

6. Data and privacy

You are the data controller for all Business Data you enter into the Platform. We act as your data processor and will process your Business Data solely to provide and improve the Service, in accordance with applicable data protection legislation including the UK GDPR and the Data Protection Act 2018.

You are responsible for ensuring you have a lawful basis to store and process any personal data relating to your clients that you enter into the Platform.

A Data Processing Agreement pursuant to Article 28 UK GDPR is available at /dpa and forms part of this agreement.

7. Intellectual property

All intellectual property rights in the Platform — including the software, design, user interface, logos, and documentation — are owned by MyTradePlatform and its operator. These terms do not grant you any rights to our intellectual property beyond the right to use the Service as a subscriber.

You retain full ownership of your Business Data at all times. We claim no intellectual property rights over the data you enter into the Platform.

8. Limitation of liability

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties, express or implied, regarding the Service, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of business, loss of data, or business interruption, however caused, whether in contract, tort, or otherwise, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising out of or relating to the Service shall not exceed the total amount you have paid to us in the twelve (12) months immediately preceding the claim. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

9. Termination

We may suspend or terminate your access to the Service if you breach these Terms of Service. Where reasonably practicable, we will provide you with written notice and an opportunity to remedy the breach before taking action.

Upon termination, your right to use the Service ceases immediately. We will retain your Business Data for 90 days after termination to allow for data export or account reactivation, after which it will be permanently deleted.

10. Governing law

These terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
